NHTSA Gives Tesla Until September 30 to Explain Cybercab Certification

The National Highway Traffic Safety Administration has put a deadline on its investigation of the Tesla Cybercab: by September 30, Tesla must answer a detailed list of questions about how the driverless robotaxi was certified for American roads. The request, reported by Reuters, centers on one awkward possibility — that the compliance basis Tesla used may have included temporary human driving controls installed only for testing.

What NHTSA Is Asking #

The core question is whether the Cybercab was properly self-certified under federal motor vehicle safety standards. NHTSA wants Tesla to state whether temporary human driving controls, or any other equipment involved in the certification process, were part of the basis for its compliance. It also wants confirmation on whether the production Cybercab can be operated by a human at all, and whether anything on the touchscreen lets a passenger move the vehicle.

The agency is asking about operating limits as well: the robotaxi’s top speed, whether service is restricted by geography or time of day, and what other constraints are baked into the system.

The Rule That Makes the Question Exist #

Under current U.S. law, a fully autonomous vehicle does not need NHTSA approval if it is equipped with a steering wheel, brake pedals, mirrors, and the other controls a human driver expects. NHTSA can also grant exemptions that let each manufacturer put up to 2,500 vehicles without human controls on public roads per year. The Cybercab has none of the traditional controls — no steering wheel, no brake or accelerator pedals, no mirrors — which puts its certification path under a microscope.

NHTSA said this month that it is reviewing the certification process and technical data Tesla used to demonstrate compliance with federal standards before deploying the car.

Why the Touchscreen Question Matters #

The touchscreen question is the sharpest one on the list. If the only way to influence the vehicle’s movement is through a software interface, then the car has no human fallback in the traditional sense. And the “temporary controls” question gets at something more basic: whether the vehicle Tesla certified is the same vehicle that is now carrying passengers in Austin.

The Industry Split Over Rewriting the Rules #

Tesla and Waymo, along with other robotaxi operators, support the Trump administration’s plan to rewrite the rules so autonomous vehicles no longer need steering wheels, brake pedals, mirrors, or other driver equipment. Critics of robotaxis oppose the changes, arguing that exemptions should not be granted before the companies prove their vehicles are safe. The Cybercab, which began commercial service in Austin on September 3 with a small fleet of two-seat cars, sits in the middle of that argument.

What Happens by September 30 #

Tesla has not commented on the request. The deadline gives the company roughly two weeks to produce answers, and those answers will determine whether the Austin rollout is seen as a compliant operation or a certification shortcut. For now, the first week of public service is running while the question of how the car got legal hangs over it.
